Maintaining Private Storm Water Drains Is Your Liability

Do you own residential, commercial, or industrial real estate? If so, you are responsible for maintaining private storm water drains that are located on your property. That being stated, the vast majority of private property owners may not be aware of their responsibility. This is due to the fact that storm drains are not something that most people think about on a daily basis. In fact, most people do not give much or even any thought to the storm water drains unless there is a major issue that causes their property and or the street to flood.

That is exactly where you are liable. The bottom line is that if you have a private storm water drain on your property and you fail to properly maintain it, you are responsible from a financial and legal standpoint if it causes a flood. If you property floods due to a clogged or damaged storm drain and you don’t have flood insurance, than any damage or destruction to your property or belongings will not be covered by insurance. If you’ve ever had a flood inside your property or know someone who has, than you’re well aware of what all of that water can destroy.

In essence, you will need to go out of pocket to repair the property damage and replace or fix your belongings. That could cost tens of thousands of dollars if not more. If your commercial or industrial building floods and your business is based there, you’re out of pocket for the property damage. You’re also at a loss for anything that was ruined inside the building such as equipment, computer equipment, tools, raw materials, inventory, and things of that nature. To make matters even worse, you will be losing money during the downtime.

If you’re a landlord and the property floods, you are financially and legally responsible for any losses your tenants suffer from. The next thing you need to worry about is how much damage your neighbors suffered due to the flood that you technically caused. If any of your neighbors properties flood, guess what. You’re responsible for the damages that the flood causes. If the flood causes any damages to the street, you are responsible to pay for those damages to the city, town, or municipality. The bad news is that a flood can get out of control and cost you more money than you could possibly afford.

The good news is that this can all be prevented with a proper maintenance program.  Doing that is as easy is calling in a company that specializes in cleaning and inspecting your private storm water drains.
